Terms of Service
These Terms govern your use of AeryxIQ™ (the “Service”), a drone picture archiving and communication system operated by Amhage Technology Group LLC (“Amhage”, “we”, “us”), a limited liability company organized in the State of New York, United States. By creating a workspace, signing in, or using the Service, you agree to these Terms on behalf of yourself and any organization you represent.
1. The Service
AeryxIQ stores, organizes, grades, analyzes, and archives aerial imagery and related inspection records. We provide the Service on a subscription basis as described at aeryxiq.com. We may add, change, or remove features; we will not materially reduce a paid plan’s core functionality during a paid term without notice.
2. Accounts and workspaces
- Each customer organization receives an isolated workspace. You are responsible for all activity under your workspace and for the confidentiality of credentials.
- You must be at least 18 years old and authorized to bind your organization.
- Your workspace administrator controls who has access and at what role. Removing a user is your responsibility, not ours.
- Notify us promptly at the contact address below if you suspect unauthorized access.
3. Trials, plans, and payment
- New workspaces receive a 30-day free trial of the full product. No credit card is required to start.
- When the trial ends, the workspace becomes read-only until you subscribe. Your data is not deleted at trial expiry; you keep read access to it.
- Paid plans are billed monthly in advance through Stripe, our payment processor. We do not receive or store your full card details.
- Fees are non-refundable except where required by law. You may cancel at any time; the subscription remains active through the end of the paid period and then reverts to a read-only trial state.
- We may change prices with at least 30 days’ notice, effective at your next renewal.
- You are responsible for applicable taxes other than taxes on our income.
4. Your data
You own your content. Imagery, findings, reports, and other material you upload (“Customer Data”) remain yours. You grant us only the limited licence needed to host, process, back up, transmit, and display Customer Data in order to operate the Service for you.
- We do not sell Customer Data, and we do not use it to train machine-learning models for other customers.
- You may export your data at any time using the Service’s export features (CSV, PDF, XLSX, evidence manifests) while your workspace is accessible.
- On written request we will delete a workspace and its Customer Data; deletion from routine backups follows the backup rotation described in our Privacy Policy.
5. Acceptable use
You will not, and will not permit others to:
- upload content you lack the right to upload, or that infringes another party’s rights;
- use the Service to conduct or record flights that violate applicable aviation, privacy, trespass, or surveillance laws in your jurisdiction;
- attempt to access another tenant’s workspace, probe or circumvent security controls, or interfere with the operation of the Service;
- resell or provide the Service to third parties except as inspection deliverables to your own clients;
- misrepresent an Evidence Integrity Certificate, or present altered material as sealed and verified.
We may suspend a workspace that presents a security, legal, or operational risk, and will tell you why as soon as we reasonably can.
6. Flight operations, compliance, and professional judgment
AeryxIQ is a records and analysis system, not a flight-operations, engineering, or legal service. We do not plan, authorize, or control flights, and we are not responsible for compliance with FAA Part 107 or any other aviation rule. Pilot certification features are a recordkeeping aid; the obligation to fly legally and safely is entirely yours.
Condition grades, trend projections, AI change-detection proposals, capital plans, terrain analyses, volumetric measurements, and cost estimates are screening-level, decision-support outputs. They are not a substitute for inspection by a qualified person, a licensed engineer’s assessment, a survey of record, or legal advice. Every AI output in the Service is a proposal for a human to accept or reject. Do not make safety-critical, structural, financial, or legal decisions on these outputs alone.
7. Evidence certificates
The Service can compute cryptographic hashes of stored objects and publish a verification page. This demonstrates that the stored material matches the fingerprints recorded when a report was sealed. It is a technical integrity check only. It is not a legal attestation, a chain-of-custody certification by us, a notarization, or an opinion about whether any imagery is accurate, complete, or admissible in any proceeding.
8. Availability
We aim for high availability but the Service is provided without an uptime commitment unless a separate written agreement states otherwise. We perform maintenance and updates and may do so without notice where needed for security.
9. Third-party services
The Service relies on third parties including Amazon Web Services (hosting), Stripe (payments), and, where enabled by us, an email delivery provider and a speech-to-text provider. Their handling of data is described in our Privacy Policy.
10. Warranty disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMHAGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY ANALYSIS OR ESTIMATE WILL BE ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMHAGE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST OR CORRUPTED DATA. AMHAGE’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply to liability that cannot be limited by law.
You are responsible for maintaining your own copies of material you cannot afford to lose.
12. Indemnity
You will defend and indemnify Amhage against third-party claims arising from your Customer Data, your flights, your use of the Service in breach of these Terms, or your reliance on Service outputs in a manner contrary to Section 6.
13. Term and termination
These Terms apply while you use the Service. You may stop at any time. We may terminate for material breach, unlawful use, or non-payment, with notice where practical. On termination you may export your data for 30 days unless prohibited by law.
14. Changes
We may update these Terms. Material changes will be announced on this page with a new effective date and, where email is configured, by notice to workspace administrators. Continued use after the effective date constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Monroe County, New York, and you and we each consent to that jurisdiction.
